Military prosecutors have decided not to appeal the stunning court ruling that quashed the 2007 FBI confessions of Khalid Sheikh Mohammed, the alleged mastermind behind the September 11 terrorist attacks.
The U.S. government notified the victims' families of its decision to drop the appeal. The prosecutors explained that pursuing an appeal to reinstate the confessions could tie up the legal process for years and jeopardize the hard-earned June 5, 2028, trial date. The move prioritizes moving forward with the capital military commission to avoid further prolonging the 25-year wait for justice. Air Force Lt. Col. Michael Schrama ruled that the statements Mohammed gave to FBI agents at Guantanamo Bay were not voluntary and were tainted by torture. The judge's decision detailed the severe conditions.
The judge determined that the FBI interviews took place in the same former CIA compound, failing to create a "clean break" from the compulsory psychological pressure. Furthermore, agents failed to give proper Miranda warnings or inform Mohammed of his right to a lawyer.
The ruling only suppresses the 2007 FBI confessions; it does not dismiss the eight charges against Mohammed—including conspiracy, terrorism, and the murder of 2,976 people. Mohammed and his three co-defendants (Walid bin Attash, Mustafa al-Hawsawi, and Ammar al-Baluchi) are scheduled to stand trial in June 2028 at Guantanamo Bay. Because they still face a capital military commission, they could face the death penalty if convicted.
Mohammed and two co-defendants had previously reached a plea deal to avoid the death penalty, but Defense Secretary Lloyd Austin subsequently overruled and revoked the agreements. Without the core confessions, prosecutors will have to rely on other evidence, such as telephone intercepts, transcripts, and financial documents, to prove their case.
